Ellie Health Terms of Use

These Terms of Use ("Terms") govern your use of Ellie Health's platform, including our website, mobile app, and services ("Platform"). By using our Platform, you agree to these Terms.

1. What We Do

Ellie Health helps you discover holistic and integrative health practitioners. We do not provide medical advice, diagnosis, or treatment. All practitioners on our Platform are independent providers, not our employees.

You can use our Platform to:

  • Submit symptoms, preferences, and health goals
  • Receive practitioner suggestions based on your information
  • View practitioner profiles and read reviews
  • Participate in community forums
  • Post reviews and comments

Important: You are responsible for choosing practitioners and booking appointments independently.

2. No Medical Advice - Critical Disclaimer

ALL CONTENT ON OUR PLATFORM IS FOR INFORMATIONAL PURPOSES ONLY. Our practitioner suggestions and health information do not constitute medical advice, diagnosis, or treatment.

  • Always consult licensed healthcare professionals for medical concerns
  • Never delay seeking professional medical help based on Platform content
  • Using our Platform does not create a doctor-patient relationship
  • We are not a licensed healthcare provider

3. Your Account and Responsibilities

To use certain features, you'll need an account. You agree to:

  • Provide accurate information
  • Keep your login secure
  • Be at least 18 years old (or have parental consent)
  • Not share private health information about others
  • Not post false, misleading, or harmful content
  • Not harass other users or violate laws

We may suspend accounts that violate these Terms.

4. Practitioner Information

Practitioners listed on Ellie Health are independent providers. Our suggestions are based on your preferences and available profiles, but they are not recommendations or endorsements.

You must verify practitioner qualifications, licensing, and suitability for your needs before engaging their services.

5. Community Content

When you post content (reviews, forum posts, comments), you grant us a license to display and distribute that content on our Platform. We may remove content that violates these Terms.

Warning: Other users can see your posts. Don't share confidential information.

6. Health Risks and Your Safety

By using our Platform, you acknowledge these potential risks:

  • Practitioner suggestions may not suit your specific conditions or allergies
  • Your health condition may not improve or could worsen
  • Some practitioners may not be licensed in your area
  • Health discussions may cause emotional discomfort or anxiety

If you experience adverse reactions or feel unwell after following any recommendations, seek immediate medical attention.

7. Our Limitations and Your Protection

What We're Not Responsible For:

  • Actions or advice of independent practitioners
  • Your health outcomes or decisions
  • Technical issues or data loss
  • Third-party websites we link to

Liability Limits:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELLIE HEALTH'S LIABILITY TO YOU IS LIMITED TO THE GREATER OF: (1) $100, OR (2) FEES YOU PAID US IN THE PAST 6 MONTHS.

WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR PERSONAL INJURY.

Your Responsibility:

You agree to defend and hold us harmless from claims arising from:

  • Your use of the Platform
  • Your interactions with practitioners
  • Your violation of these Terms
  • Your violation of others' rights

8. Dispute Resolution - Arbitration Agreement

Please read carefully - this affects your legal rights.

Mandatory Arbitration:

Most disputes between you and Ellie Health must be resolved through binding arbitration, not court litigation. This includes claims related to:

  • Your use of our Platform
  • These Terms or our Privacy Policy
  • Interactions with practitioners found through our Platform

Exceptions:

You may still go to court for:

  • Small claims court cases (if they qualify)
  • Intellectual property disputes
  • Requests for injunctive relief

How Arbitration Works:

  • Try to Resolve First: Before starting arbitration, we'll try to resolve disputes informally through a good-faith discussion
  • Arbitration Rules: Disputes will be handled by the American Arbitration Association (AAA) under their Consumer Arbitration Rules
  • Individual Basis Only: No class actions, group lawsuits, or representative actions are allowed
  • Location: Arbitration occurs in your county of residence
  • Costs: You pay standard AAA filing fees; we cover additional arbitration costs

30-Day Opt-Out Right:

You can opt out of arbitration by emailing hello@elliehealth.co within 30 days of agreeing to these Terms. Include your name, address, and clear statement that you're opting out.

9. Changes and Termination

We may update these Terms by posting changes on our Platform. Continued use means you accept the updates.

Either party can terminate this agreement. When terminated:

  • Your access to the Platform ends
  • Certain provisions (like dispute resolution) continue to apply
  • We're not liable for termination effects

10. General Terms

  • Governing Law: California law governs these Terms
  • Entire Agreement: These Terms constitute the complete agreement between us
  • Severability: If any provision is invalid, the rest remains in effect
